1. Agreement to Terms

By accessing or using Forminos ("the Service"), operated by Forminos ("we", "us", or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you may not access or use the Service.

We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the revised terms. We will notify registered users of material changes via email.

2. Description of Service

Forminos is a cloud-based form building platform that enables users to create, design, and deploy conversational and traditional forms. The Service includes a web application, form builder tools, analytics dashboards, integrations, and related documentation.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account details updated. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must be at least 16 years of age to create an account. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these terms on your behalf.

4. Subscriptions & Billing

Forminos offers a free tier and paid subscription plans. Paid plans are billed on a quarterly or annual basis as selected at the time of purchase. All prices are listed in Euros (EUR) and are exclusive of applicable taxes unless stated otherwise.

Subscriptions renew automatically unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing cycle.

We reserve the right to modify pricing with 30 days' advance notice. Price changes will not affect your current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe upon the intellectual property rights of others
• Transmit malware, viruses, or other harmful code
• Collect personal data of end users without proper consent and legal basis
• Send spam, phishing, or unsolicited communications through forms
• Attempt to gain unauthorized access to the Service or its infrastructure
• Interfere with the performance or availability of the Service
• Use the Service for any fraudulent or deceptive activity

We may suspend or terminate your account if we reasonably believe you are in violation of these terms.

6. Intellectual Property

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, design, and software) are owned by Forminos and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all content you create using the Service, including form designs, configurations, and collected responses. By using the Service, you grant us a limited license to host, store, and process your content solely to provide the Service.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring your use of the Service complies with applicable data protection laws, including GDPR, when collecting data from your end users through forms built with Forminos.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Forminos shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we determine violates these terms or is harmful to the Service, other users, or third parties.

Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a period of 30 days following termination, after which it may be permanently deleted.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the European Union and applicable member state law. Any disputes shall be resolved in the competent courts of the jurisdiction in which Forminos operates.
